3D Model Download Terms
These terms apply whenever you download a 3D model file (a File) with Download 3D model in your Ring Facet dashboard.
They are an agreement between the business that holds the Ring Facet account (you) and Ring Facet (we, us). By ticking “I agree” you accept them on behalf of that business and confirm you are authorised to do so. If you do not agree, do not download Files. These terms add to any other terms that govern your use of Ring Facet. For Files, these terms prevail where the two conflict.
1. What a File is
- A File is generated automatically from the 3D display models in your ring builder, at the options you chose: shape, carat, ring size, setting, band and metal.
- It is a mesh for reference. It is not production CAD, and nobody has checked it for manufacture.
- It may differ from the ring on screen, from any original model you uploaded, and from a finished ring. Sizing for carat scales the setting, which changes prong and wall thickness. Ring sizing reshapes the band. A mesh may be open, overlapping or contain errors, and stones are approximations.
- Ring Facet does not guarantee any weight, dimension, thickness, stone size or fit.
2. Your responsibilities
- Before you use a File to make, cast, print or sell anything, have a qualified jewellery CAD designer or manufacturer check and correct it, including dimensions, wall and prong thickness, stone seats and fit, ring size, metal weight and castability.
- You alone decide whether and how to use a File. You are solely responsible for anything made from it and for every sale to your customers, including quality, safety, durability, stone security, metal content, hallmarking, labelling, and compliance with the laws that apply to you and your customers.
- You will not tell anyone that Ring Facet designed, checked, made or guarantees a ring made from a File.
3. Ring Facet catalogue models
- Some Files contain models from the Ring Facet catalogue (Catalogue Models). Ring Facet and its licensors keep all rights in them.
- Subject to these terms, and to the extent Ring Facet has the right to grant it, Ring Facet gives you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use a File that contains Catalogue Models only to make rings ordered by your own customers, while you have a Ring Facet account.
- You may share such a File only with your own manufacturer or CAD designer for that purpose, and only if they keep it confidential and are bound by terms at least as protective as these.
- You may not sell, license, publish, share or redistribute a File or a Catalogue Model as a file; upload one to a marketplace, library or file-sharing service; use one to build a competing catalogue or product; or use one to train or improve a machine-learning model.
- Ring Facet may withdraw a Catalogue Model, or this licence, at any time, for example after a claim by a third party. When we tell you, you will stop using the affected Files and delete every copy that you and your manufacturer or designer hold.
- Catalogue Models come with no promise that they are free of third-party rights.
4. Your own models
- A File made from models you uploaded is returned for your own use. Uploading a model gives you no rights in it that you did not already have.
- You confirm that you hold every right needed to upload your models and to use Files made from them, and that doing so infringes no one else’s rights.
5. No warranty
Files, Catalogue Models and Download 3D model are provided “as is” and “as available”, with all faults. To the fullest extent the law allows, Ring Facet disclaims every warranty and condition, express or implied, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy, completeness, non-infringement, and that a File is free of errors.
6. Limitation of liability
- To the fullest extent the law allows, Ring Facet is not liable for any loss or damage arising from or connected with a File, a Catalogue Model or Download 3D model, however caused, including by negligence. That includes lost profits, revenue, business or goodwill; wasted metal, stones, labour or manufacturing costs; remakes, refunds and returns; claims by your customers or anyone else; and any indirect, incidental, special, consequential or punitive loss.
- Where the law does not allow liability to be excluded, Ring Facet’s total liability for all claims connected with Files is limited to USD 100.
- Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited, such as liability for fraud, or for death or personal injury caused by negligence.
7. Indemnity
You will defend, indemnify and hold harmless Ring Facet, its affiliates, officers, employees and licensors against every claim, loss, liability, cost and expense, including reasonable legal fees, arising from: any ring or product made, sold or supplied using a File; your breach of these terms; the models you uploaded; or your manufacturer’s or designer’s use of a File.
8. Records
Each time these terms are accepted we record the account, the user, their email address, the version and the time.
9. Changes and ending
- We may change these terms. A new version applies to downloads made after you accept it, and you will be asked to agree again before your next download.
- We may suspend or stop Download 3D model, or your access to it, at any time.
- Sections 2, 3 (its restrictions and the duty to delete), 5, 6, 7 and 10 continue after your account or this licence ends.
10. General
- These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules, and the courts of British Columbia sitting in Vancouver have exclusive jurisdiction over any dispute about them.
- If any part of these terms is unenforceable, the rest still applies, and that part applies to the fullest extent allowed.
